Abstract

This study into resolving the case of theft along the route of the Laos-China railway in Luang Prabang province had two aims: to study the causes leading to the cases of theft; the difficulties in resolving the cases of theft; and penalties to eliminate and methods to resolve cases of theft along the route of the Laos-China Railway. The methods used in the study, were to use theory, the laws of the Lao PDR, and a number of research papers in addition to interviews with police officials, public prosecutors, and judges in Luang Prang and the collection of statistics from various entities. After this, we explained and analyzed data both qualitatively and quantitively.

The results of the study found that in 2021-2022, the Luang Prabang police had encountered six cases of theft along the route of the Laos-China Railway, of which two are undergoing investigations by officials, the case file summaries of four have been sent to the Public Prosecutor for prosecution, two still remain with the Public Prosecutor, and two have been sent to the courts for adjudication. It was seen that in the resolution of the cases of theft along the route of the Laos-China Railway by the organizations with the relevant duties and responsibilities took place in strict accordance with the stages and legal regulations concerned.

The study also found that there were difficulties in operations to resolve the cases of theft along the route of the Laos-China Railway due to a general lack of budgets, vehicles, materials and equipment, tools for use in prosecution, and personnel, whose competencies in the performance of their works remained low and a number of the offenders escaped.

The study also delved into the causes for the thefts along the Laos-China Railway, which revealed the lack of deep understanding and knowledge into the policies of the Party and the laws of the State. There was an apparent lack of ethics, inability to distinguish good from bad, greed, the desire for taking that which belongs to others illegally, drug parties, illegal gambling, overindulgence, unemployment, and poverty.

In addition, the organizations dealing with these cases also lacked efficiency and effectiveness, and a lack of proactive responsibility in coordinating with the relevant organizations and other State organizations so as to focus on resolving these problems together. These issues have become the primary causes leading to the occurrence of theft along the route of the Laos-China Railway.

This study therefore includes proposals for methods to resolve such matters in the future and things which have been problematic thus far, such as increasing the knowledge of politics and specialized subjects for employees, which would allow them to be more responsible over their occupational duties while at the same time, implementing the law strictly, increasing the number of employees and the budgets for the relevant entities to be adequate for the needs and organizations responsible for liaising and coordinating with each other smoothly and also applying the policies of the Party and laws of the State by disseminating them amongst the public residing along the route of the Laos-China Railway for them to take in, get to grips with, and enhance their awareness and respect for the law.
